Council Meeting Minutes - April 14, 2010


The Council Meeting of the Village of Moreland Hills was called to order by Mayor Susan Renda at 7:03 p.m.

PRESENT AT ROLL CALL: Mr. Stanard, Ms. Sturgis, Mr. Wortzman, Mr. Buczek, Mrs. Cooper, Mr. Richman.

ALSO PRESENT: Mayor Susan Renda, Assistant Law Director Vesna Mijic-Barisic, Village Engineer Jeff Filarski, Building Commissioner Greg Potts, Service Director Ted DeWater, and Clerk of Council ProTem Catherine Peters.


Mr. Stanard made a motion seconded by Mrs. Cooper to approve the minutes of March 10, 2010 Council Meeting.

REPORT FROM THE MAYOR

Mayor Renda recognized Orange Village Police Sergeant Roberts and Patrolmen Sommers along with Chief Flauto, Lieutenant Wyant, Officers Bedoe and Bennett from our Moreland Hills Village Police Department who were attending this meeting to see Officer Richard D. Roberts receive a proclamation. Mayor Renda then gave Officer Roberts a proclamation honoring his service to Moreland Hills and introduced his wife and son to Council.


COMMUNICATION FROM THE MAYOR

Mayor Renda advised that Pepper Pike decided to remove their support of the EfficientGovNow collaboration and without their support Moreland Hills will have to withdraw the grant request which will be disappointing for our residents. Moreland Hills will continue to work with Orange Mayor Kathy Mulcahy for ways to improve services and share costs between the Villages.


REPORTS OF COMMITTEES

Finance Committee
Mr. Wortzman stated that the Finance Meeting of April 6th emphasized looking at finances in a more in-depth, line-by-line review. He also noted that income tax revenue is 12% below last year’s and real estate taxes are 5% below last year. The committee will remain very focused on our two major projects which are the Waste Water Treatment plants and the new Service Building.

Mr. Wortzman made a motion seconded by Mr. Richman to allow the Village of Moreland Hills to donate $500.00 to both Orange High School and Chagrin Falls High School for the after-prom committee.

Mr. Wortzman made a motion seconded by Ms. Sturgis to allow the Village of Moreland Hills to donate $100.00 to Safety Town.

Safety Committee
Ms. Sturgis reported that officers are participating in domestic violence training sessions being held April 15th and May 13th. The department will participate in the National Police Memorial Week (May 15th – 19th) and the Orange Jubilee (May 21st and 22nd). Next Safety Committee Meeting is Tuesday, April 27th, all residents are welcome.

Buildings and Grounds Committee
Mr. Richman stated the committee met on March 24th to discuss updates on signage and miscellaneous items. There was a tour of the Village buildings and grounds to determine what needs to be replaced and the list was given to the Finance Committee to evaluate the needs before moving forward. He also encouraged council members to join the Historical Society and passed out membership forms.

Utilities Committee
Mr. Buczek stated the committee met March 22nd and that the design contract for the three pump stations is progressing. The project will be completed in 2011 and is expected to save money and reduce capital expenses. The next meeting will take place April 26th.

Planning Commission
Mrs. Cooper discussed the presentation from Phil Dickinson regarding the new gym that is needed for Brady Middle School. The construction will include a large storm water system that will provide protection to natural watercourses. It was also noted by Mrs. Cooper that several dead trees will be removed from the job site without the need of a permit. Next meeting will be April 26th.

Service Committee
Mr. Stanard stated the committee met on March 24th. The Service Director is currently formalizing a policy to assist certain seniors in getting their carts to the curb. Draining/ditching will start up next week. The department is currently test driving recycling vehicles. The first phase of the road program is now underway. Next meeting will be April 28th.

*Ordinance 2010-4 was introduced by Mr. Wortzman. An Ordinance for the payment of the bills in the month of April in the amount of $685,294.63 and declaring an emergency.

Mr. Wortzman made a motion seconded by Mr. Stanard to suspend the rules for Ordinance 2010-04.

*Ordinance 2010-33 was introduced by Mr. Richman. An Ordinance amending existing sections 1325.04, 1325.05, and 1325.13 of chapter 1325, signs and billboards, of the codified ordinances of the Village of Moreland Hills to amend the regulation of signs within the Village of Moreland Hills to provide for the regulation of temporary signs. First Reading.

A motion was made by Mr. Richman to move Ordinance 2010-33 to Second Reading and seconded by Mr. Buczek.

*Ordinance 2010-36 was introduced by Mr. Wortzman to approve and adopt current replacement pages to the codified ordinances and declaring an emergency.

*Resolution 2010-37 was introduced by Mr. Stanard authorizing participation in a consortium to request proposals for recycling processing services.

Mr. Stanard explained that joining this consortium would allow the village flexibility for recycling in the future.

*Ordinance 2010-38 was introduced by Mr. Wortzman providing additional appropriations, transferring items already appropriated and declaring an emergency.

*Ordinance 2010-39 was introduced by Mr. Buczek. An ordinance authorizing the Mayor to enter into a contract with Infinity Construction Company for the Village of Moreland Hills Service Department Improvements Project at a cost not to exceed two million ninety-eight thousand eight hundred dollars ($2,098,800) and declaring an emergency.

Mayor Renda noted that we need to remember and honor former Councilwoman Kelly Ovsek who helped push this project through during its infancy. Kudos were also given to Mr. Potts, Mr. DeWater, Ms. Cannon, all of Council and Mr. Thornton of R.E. Warner for their support in bringing this project to fruition.

Mr. Richman asked about Infinity Construction Company’s expertise to which Mr. Potts responded that they have worked with Infinity in the past citing the work done on the community building addition. Mr. Buczek added that we were able to add two items due to the favorable cost of the project.

Mr. Buczek made a motion seconded by Mrs. Cooper to allow the Mayor to utilize CMM Inc. for the removal of EPA Regulated asbestos materials from the service facility prior to demolition of the structure in the amount of $12,200.00. CMM Inc. will follow all State of Ohio guidelines for EPA Notification, removal, and disposal of materials.

Mr. Buczek explained that CMM has conducted a thorough inspection of the facility, collected samples of materials, and had the samples analyzed by a laboratory to verify all materials that need to be removed to provide for the safe demolition of the service structure.
