Planning Commission Meeting Minutes - July 28, 2014


The meeting was called to order by Councilman Stanard at 6:20pm.

PRESENT AT ROLL CALL: Mr. Bolek, Mrs. Cooper, Ms. Corcoran, Mayor Renda, Mr. Stanard

Others Present: Dave Strichko, Building Inspector, Aimee Lane, Assistant Law Director, Sherri Arrietta, Clerk of Council

Mayor Renda made a motion seconded by Ms. Corcoran to approve the minutes of the June 23, 2014 meeting.

Richard Brown

Addition

Mr. Ron Kluchin, architect and Mr. and Mrs. Brown, homeowners, were present at the meeting. Mr. Kluchin stated that Mr. and Mrs. Brown are proposing a 2,500 sq. ft. addition to their 3,500 sq. ft. home which will consist of a combination kitchen and hearth room with an open porch that looks down into the pool area. All materials will match the existing house. He stated that some interior remodeling will be done as well (on first floor and basement). The plans were approved by the architect without any notes or comments.

Mr. Bolek complimented Mr. Kluchin’s work but expressed his concern regarding the 3/8 slope and the separation holding the load. Mr. Kluchin stated it has a rubber roof and will be completely ice guarded on the sides.

Mr. Stanard asked about the removal of 24 trees for the pool which was approved last month. Mr. Brown stated that they have all been cleared. Mr. Stanard asked about the addition of new trees to shield the pool area because several of his neighbors on Hemlock have expressed concern over the removal of the trees and therefore he would just like to suggest that anything that the applicants can do to shield the pool by adding more plantings would be greatly appreciated. Mr. Brown stated that they do have a landscape plan that includes the addition of more trees/landscaping.

Mrs. Cooper made a motion seconded by Mr. Bolek to approve the new addition located at 60 Basswood Lane.

Richard Kawalek
35100 Miles Road

Mr. Richard Kawalek, homeowner, was present at the meeting. He stated that he is proposing to build a two-car garage that will match the house (siding, roof slope, etc.). The garage will mainly be used for storage and will be placed at the rear of the property. No neighbors will be affected to the rear because the property backs up to the Metroparks. The architect (Ted Wolf) approved the plans without any notes.

Mr. Stanard made a motion seconded by Ms. Corcoran to approve the garage located 35100 Miles Road.

Discussion:
Mayor Renda asked Mr. Strichko for an update on the Haas residence. Mr. Strichko stated that their extended deadline has expired; they are having trouble receiving materials (doors and countertops) that were ordered from another country. He stated that the plumber cannot do a final inspection because no sinks have been installed. Mayor Renda asked for an explanation of the process to obtain the occupancy permit. Mr. Strichko stated that a final inspection would be required to be performed and the inspector would have to verify that everything has been constructed per the approved documents, which it has been to this point for this project. He stated that in this case, it is a little different because he and Mrs. Lane are working on verbiage relating to contingencies and stipulations to include on the Haas occupancy. Mrs. Lane stated that they will be adding an acknowledgement page to be signed by the Mr. and Mrs. Haas acknowledging the fact they did commence the work without appropriate plan approval, which essentially means that they will be assuming the risk for things that cannot be inspected. She stated that the Planning Commissions conditions from November are still outstanding; the Haas’ were asked to sign a release and asked that an “affidavit on fact relating to title” be recorded, which would put future purchasers on notice that work was done without plan approval. Mrs. Lane stated that she has not yet received a response from the homeowners but that she has communicated with their lawyer and informed him that the occupancy permit would not be issued until the Planning Commission conditions were met.

A discussion ensued regarding extended the deadline. Mr. Strichko stated that getting the contractors to cooperate is not the problem; however, getting the homeowners to sign the required documents is going to be. Mrs. Lane stated that the Village’s leverage is the occupancy permit; they will not receive that until they comply. Mr. Stanard stated that he likes the idea of keeping the building permit issue separate from the occupancy permit in order to keep the project moving along and they should be given a new deadline for the work to be completed. Mr. Strichko stated that he will contact the contractors and get a new date for another extension for the completion of the work.

Mrs. Cooper asked Mr. Strichko for an update on the project on 3660 Chagrin River Road (Pavlos Pavlidis). Mr. Strichko stated that they have been working steadily however the work was more extensive than Mr. Pavlidis originally anticipated.

Ms. Corcoran asked about the work hours and why they were highlighted in Mr. Strichko’s plan review report. Mr. Strichko stated that he has been getting a lot of questions recently regarding work times and that is why he has been including them in all his plan review reports.

Mayor Renda made a motion seconded by Mr. Stanard to adjourn the meeting at 6:55pm.
